(a) The Texas County and District Retirement System (the system) receives a substantial number and variety of domestic relations orders (as that term is defined in §109.2 of the title (relating to Definitions)) which purport to divide the accumulated contributions of members of the system, and/or the retirement benefits of such members, as part of divorce or other domestic relations proceedings.
(b) Many of those orders contain provisions that would require the system to attempt to determine what effect the order is intended to have on accumulated contributions and/or retirement benefits upon the happening of certain events. The board of trustees of the system has therefore adopted the sections and procedures set forth in this chapter, in order to establish a process whereunder it can be determined if a particular domestic relations order clearly divides all benefits that may be payable under the Act governing the system, clearly advises thesystem as to whom benefits are to be paid and in what manner, and does not purport to require payments to be made in a manner that would conflict with the Act governing the system.
