Rule 34.58 Referral to the State Office of Administrative Hearings

(a) If mediation does not resolve the claim, the contractor may request that the claim be referred to SOAH by the department in accordance with §34.29 of this title (relating to Request for Contested Case Hearings). (b) SOAH procedural rules shall control a contested case proceeding brought under this chapter. The rules contained in 37 Texas Administrative Code, Chapter 29 (relating to Practice and Procedure), are not applicable.
