A cotton grower, who applies for an exemption from assessment penalties under §3.76 of this chapter (relating to Application for Exemption from Assessment Penalty), may apply with the department, using a form prescribed by the commissioner, for permission to establish a payment plan for the assessment penalty. Forms may be obtained by contacting the Texas Department of Agriculture, P.O. Box 12847, Austin, Texas 78711. A separate application must be made for each year in which a payment plan is requested.
