The resident has the right to retain and use personal possessions, including some furnishings, and appropriate clothing as space permits, unless to do so would infringe upon the rights or health and safety of other residents. Reasons for any limitations are documented in the resident's clinical record.
(1) If the resident dies, personal property must be transferred to the estate or the person designated by the resident.
(2) If it is donated or sold to the facility by the resident or estate, the transaction must be documented.
(3) If the resident dies and there is no resident representative or family and no arrangements have been made for the disposition of property, the facility must dispose of property according to the Texas Property Code, Title 6, Chapter 71 (concerning Escheat of Property) and according to the Texas Estates Code, Chapter 551 (concerning Payment of Certain Estates to State).
